What is an uncontested divorce?
An uncontested divorce is a divorce that is being agreed to by the other party. It is not disputed so the process is usually simple, quick, and costs less than a contested divorce. The process is normally straightforward and will not require you to attend court. It is usually around 6 months to completion, although this will vary depending on how quickly both parties submit their paperwork and how busy the court is. In most circumstances, a fixed fee is applied for this kind of divorce, which will provide you with a divorce attorney to work specifically with you throughout this journey.

What is the difference between a contested and uncontested divorce?
A contested divorce is more complicated, as the respondent party has chosen to defend the divorce. There are many reasons they may choose to do this. It could be that they do not agree to the divorce at all, or that they disagree with the ‘fact’ that you have cited as a reason for divorce. This procedure will involve court hearings that will require both of you to give evidence. Ultimately the Judge will decide whether the divorce is entitled to go ahead or not. It is not common for a divorce to be contested as if the Respondent is unsuccessful in their defense the Court often makes them pay court costs.

The process
